My oldest son has enlisted in the Navy. He's just waiting to make the list from our area. He didn't make the boot camp list for August or September. He really can't wait to go. But he was two courses short for graduation and opted to get a GED issued diploma rather than be a 5th year high school student for just two courses. The Navy are choosing people with HS diplomas first, then the GED's, and they only take a few from our area. They had a slot for him last month and told him to come in, and at the last minute, they filled his slot with someone who walked in off the street who qualified. So, he's patiently waiting, working for a discount chain loading trucks and doing deliveries. That is until today. Today his employer told him that since he was going to be going into the navy, he hired his replacement already and started the guy. Nice. Now my son has no job. That's a nice big american thanks isn't it.:thumbsdown:
 
That really sucks.... that's like telling me "ok, well, you're going to retire in x number of years.... so we're just gonna fire you now" or "we don't think this will be your permanent career, so we just went ahead and got someone else to fill your shoes." I'd be really upset. :(
 
to my knowledge, that's actually VERY illegal. it's actually technically discriminating against him for choosing to enlist, because they dismissed him rather than allowing him to take his federally protected leave for duty. i'd be contacting a lawyer if i were you.
 
federal law actually provides protection for his job, not only until he leaves, but also when he returns, if he chooses to go back there.

since her son never actually attained active duty status, it may not be protected. (i did 5 years in the navy.. i'm familiar with the leave and work policies for reservists and the like) it's not considered a protected job if the employee is leaving for a contracted active duty status. that law applies to reservists who leave their jobs for <1 year, though im not sure how it has changed with current world events.

as for the navy turning him down for GED status... i went through the same EXACT thing.. turned down a 5th year of HS.. went for my GED.. i waited a solid 364 days before i went to boot camp. that's just the breaks, and it sucks..

but i would definitely pursue your options with the employer. legally.
 
they cannot hire someone for his position before he has been accepted to the Navy for duty. Did your son actuallly tell them he would be leaving on a given date? If not, I would say that employer needs some attorney contacting him. It's like saying to me, well, you are going to be moving to another state one day so we already hired your replacement. Are you kidding me??
 
you have no legal options your son should have stayed in school

It was the best thing I ever could have ever done at that point in my life. I got my GED after about a year in because it was a pre-req for the course I was graduating. Help him keep his head up and let him know that there are many that appreciate his wanting to serve. If he's focused and motivated, he has no limits!
