Indianapolis Dad Sentenced to 8 Years in Prison After Son Fatally Shoots Younger Sister

INDIANAPOLIS — An Indianapolis man has been sentenced to eight years in prison for neglect after his 5-year-old son accidentally shot and killed his younger sister with their father's semiautomatic handgun.
A judge said Thursday that 27-year-old James Michael Booher should have placed the gun in a safer place since the boy had taken the gun from atop a refrigerator and shot a bullet into a kitchen cabinet eight months before.
Four-year-old Makayla Booher was shot in the head in May 2008. Authorities said her brother had taken the gun from the top shelf of a bookcase.
Defense attorney Jane Ruemmele disagreed with the sentence, noting Booher still is grieving.
The judge also barred Booher from seeing the boy while he is on probation or from living with anyone younger than 18.

So sad, but I agree it's good they punished him... I mean it was partially the kids fault but mostly the dad's fault for leaving a LOADED GUN where a 5-year-old could get to it! If they didn't punish him for that they should've punished him for the emotional trauma that kid's probably going through right now!!:mad:

Sad story the whole way around, but come on parents where is your brains. If the kid got the gun 8 months earlier from atop of the fridge and shot a hole in the cabinets, why did he think that atop of a book shelf was any better. HELLO LOCKED GUNCASE/CABINET.

I disagree. NONE of the responsibility for this tragedy can be laid on a 5 year old child. None. No more than I could blame my own 5 year old daughter if she accidentally discharged a weapon. Why? Because as a 27 year old woman, I should d*** well know better than to leave a deadly weapon where a child can get to it. It was neglect and STUPIDITY.

Personally I think that the punishment for this man should include chemical castration. He does not deserve to add to the gene pool.

Poor, poor babies, to suffer for the stupidity of an adult that plain should have known better, especially after his son had gotten to the gun once before.

Is there a reason the mother was not also charged? The article doesn't mention anything about it.

If she lived in the same house, she should be charged as well imo.
