i bought a Aqua Tech at walmart a couple weeks about just to see how they work and for soem reason i cant push the filter pad dpwn all the way or it will overflow and some of the water will flow out where the filters tube ... anyone no why its doign this ?

it isn't just the filter pad displacing the water is it?

you should be able to insert the pad into the slots until it bottoms out. it should also be down far enough to be able to close the lid. water may displace a little at first but should stop fairly fast. if after a couple minutes the water still bypasses i would really closely examine the filter and box for problems and obstructions.

It's possible you are putting the filter upside down. The filter narrows ever so slightly from top to bottom and the narrow side goes down, with the floss away from the biowheel.
