Problem with Ebay buyer

I sent a shipment of snails and shrimp to New York, it was suppose to get 45 at night, so I sent a heat pack, separated by styro walls.

He said 5 shrimp died and 1 snails, thats about less than half the stuff in there. I said I would refund him for the lost after he sent pic, but then he opened a dispute.

He never responded about the pic, or about anything, and says that I should have used a cold pack? cause it was 65 degrees?

He won the dispute and I have to refund everything even shipping, and he gets to keep the snails and shrimp, is this fair?
 
What were your guidelines for the sale....
 
No I don't see it as fair. Did you have in the post that any dead arrivals had to be photographed in the bag w/in xx amount of time? If not ,you might want to consider something along those lines to help in any future issues that may arise.
 
I said that it needed to be reported within 4 hours of delivery, it wasnt, but I forgot to put the "picture" part in there, will do from now on

UGH! this makes me so mad! I am paying him to keep my pets
 
did you ship overnight delivery? isnt it ebays policy that fish & live things must be sent overnight next day delivery? and yes ebay now requires shipping to be refunded. is it fair? well sometimes yes and sometimes no i would avoid selling live critters on ebay and use sites like this one to sell your stuff. Here you can clearly state if you dont pay for overnight delivery you make no guarantee on live delivery and no refunds on shipping or purchase.

One of the reasons to try to avoid dealing online. It is completely unfair, the buyer is a tool, and you'll lose no matter what you choose to do. That being, how do the disputes work? He just complains, they hear nothing from you, and he wins?

Thats true, makes me feel better, It seems I stop selling on ebay every year around this time because of their "policies" that dont benefit small sellers.

I use priority since I have had good success with it,
I guarantee live arrival, and have refunded and reshipped several times as long as they provide a picture, This guy just wants things for free.

He complains to ebay after not responding to my request for a picture, they open a dispute with his lies, then, I explain my reasoning and offer a partial refund, he then denies it, or not, in this case denies it, and sends it to ebay for a full refund, they review the case and lack of evidence......and he gets to keep my snails and shrimp
