Anyone has Odyssea 10gal tank?

Just wanna get some opinion here...so I bought this tank and the tank turns out all scratched and looks used...I told the seller that...and he said to ship it back to him and he will send a new one. So in this case...do I have to pay for the shipping to send it back to him? Something thats defective like that?:confused:
I told him that the tank should have been a brand new one and its not fair enough already that I received one in that bad of a condition and yet have to pay to ship it back.
So I told him to have the UPS guy pick it up when he sends the new one...but he replied and asks me to fill out a UPS damage claim form.:confused:
The tank was clearly not damaged from shipping....so what are your thoughts?? :help:
 
I don't think you are going to get anywhere with UPS. All shipments are insured for $100 automatically, but they might send a guy to your house to inspect the packaged and it sounds like the seller did not pack properly. I bet it only costs a few $$$ to ship the item back via USPS. I say cut your looses while the seller is still willing to deal. Send it back and hope the new is good.
 
Poor Packing

Yes it was poorly packed. He shipped it straight in a box with no padding whatsoever. But the tank wasn't damaged from shipping...it was the original condition of the tank sent to me...cause all the damage was on the inside of the tank(which was covered with an Odyssea picture paper)....so there no way scratches could have developed during shipping. The scratches were between the paper and the tank...just couldn't believe he was blaming UPS for it and not wanting to take responsibilities.
