I was wondering if its ok or will it melt the plastic?? it I just wanted to have it sit a little lower to the water.

Higher is usually better for dispersing the light, so if you have the legs, use 'em. If you don't have them, I've seen people do it without the legs. Shouldn't be a problem.
Thats how I have mine just because I dont have legs, it seems to be fine. The only problem being That there is evaporation on the bulbs, and I had some weird snot looking stuff on there.
