Ok double hint one not so big. Its a colubrid. The other hint it lives here in one of the conjoining states so hawaii and alaska are out.

I got it! Seminatrix pygaea. Storeria usually have markings on the side of the neck. It was bothering me even after I posted and just as I nodded off to take nap it hit me!
