The ultimate responsibility for your child lies with you in my opinion. If my children are not being accommodated at school properly, then it's my responsibility to see to it that they are or to move them to a more appropriate situation, whether it's another school or into a homeschooling situation.
Addressing a problem is necessary but if the system does not make the needed corrections (and QUICKLY!), rather than continue to send my kid into a bullying situation, I'd remove my child. It isn't about the fact that the school is supposed to host a comfortable environment for everyone....it's about the fact of whether the school IS creating that situation.....and if they are not, I'm not going to continue to put my child in the situation. It's not about what is right or wrong when it comes to my kid, it's about what IS....and the ultimate responsibility for my child lies with me.
That's my take on it.
I also have no details of this case so cant' speak to it specifically. My comments above are generic, not specific to this situation.
