Monster Energy Drinks vs. Monster Fish Keepers...spread the word!

All of you are doing an amazing job! Every Facebook share, every Tweet, every Reddit bump, every person you explain this to (even if they have no clue who we are)...every attempt you make to get this out there, is a boost. We need it and we appreciate it!

There have been several letters suggested, here is another one. This one is from Heather O'Connell of MFK:

"Dear _________,

I am deeply dismayed to learn that Monster Energy has issued a cease and desist order to Monster Aquaria Network, the operators of the Monster Fish Keepers website, over trademark infringement. The letter stated that both the word “Monster” and the “monster M” logo for the website, stop being used, despite the fact that the trademarks have been registered since 2007.

In that letter, it was stated that a hypothetical similarity between the Monster Energy and Monster Fish Keeper logos would confuse consumers -- ie, that the people who drink Monster Energy products are too stupid to tell the difference between the two! This asserts that consumers (a pejorative at this point!) are incapable of discerning the following elements of the Monster Fish Keepers logo that distinguish it from the Monster Energy logo:

- horn and tail spade embellishments and serifs extending from a smooth margin , as opposed to irregular edges tapering to points,

- a white letter on a navy blue field, as opposed to yellow-green or cyan on a black field,

- an outer glow layer style effect instead of bevel and emboss.

Continental Enterprises, the company contracted by Monster Energy, is causing more harm than good by sending out blanket cease and desist orders. By doing so, they have provoked portions of Monster Energy's consumer base to boycott! I suggest that your company contract another intellectual property protection that will do a better job with the money with which they were paid.

Sort of got a reply from the lfs. It said they are going to get back to me but they are working on their site (last I found it was updated in like 2009). I think the email address I found was more for companies to get them to sell their product. But it was next to the phone number, so I figured why not. But I know they use that email address, hopefully they are actually improving their site, because it sucks right now.

"Monster Energy's claims are the definition of frivolous. The logos look nothing alike, and Monster Energy's demands are ludicrous. I highly doubt someone is going to accidentally wind up buying a large fish when they meant to purchase an energy drink due to brand confusion."

I'd hate for someone to get the wrong tattoo, too...

I need one too. This really upsets me. I've sent out 8 emails to Monster and news programs, I've signed the petition, shared it twice on my facebook, shared the consumerist article on facebook, I've joined the facebook group, even emailed my favorite youtuber....and I still feel like I'm not doing enough. My facebook shares have gotten 3 signatures for the petition (fiancee, roommate, and mom, so it doesn't really count, lol), I've recieved no responses as of yet (not that I really expected any). I just don't know what else to do, I feel like ripping my hair out. This site is so wonderful, I check it at least 10-20 times a day, to see responses to my posts, help others, just see what's new....I can't imagine not having this wonderful community as a resource. Not to mention the sense of family that's here. I've only been here about 4 months, but I love all you guys, and I love this site. This really is sad...and will be a tragedy if we can't win.

You and LBF are really trying hard to get the word out there. I think you deserve a break. I will be making a video tomorrow too. I dont think we would just loose the forum just like that. And if we did, I am sure something could be set up temporarily. I think the worst that would happen as of now is having to change the name and logo. But with everyone getting the word out, we will be OK for now. I think that if it did end up in court somehow, it would end up in our favor.

I know it isnt quite time yet, but we might want to consider setting up an indiegogo thing if this ends up going to court. I would dontate for sure.

Is that supposed to be me? Idk if they ever got uploaded but I did heat and shoot/smash pop cans with bb guns and my blitz.

We will have to see if I get a hold of a can without buying it from a store. Otherwise i might get a cheap tea that has a similar can to monster and just wrap a monster logo around it and shoot it (my 1410 needs a new endbell :().

For every one of us that IS trying to get word out, there's going to be 50 of us who just use the site like normal, maybe just sign the petition and go on with their day. If we don't get enough public awareness, then I don't see how or why Monster would even consider backing down. And if we go to court, I don't see how Neoprodigy can afford to keep the site going, when Monster can just appeal and appeal and appeal, even if we win...THAT is what I'm talking about when I talk about losing this site. We could cave and change the logo/name...but even then, that involves getting a new domain name, which costs money. At BEST, if Monster is able to take us to court, this site probably won't stay free to join, or we'll have a new domain and probably some weird switchover things. At worst, it will be completely taken down and done for. I don't really like either of those options. We didn't do anything wrong and we should be able to continue as we have been doing. I'm perfectly willing to work for that, as hard as I possibly can. This site has supported me in this new adventure of mine and has helped me find the hobby that I have fallen in love with more than any other hobby I've ever had. Fishkeeping has helped to pull me out of a terrible depression, and gave me a reason to get up in the morning, it made me feel good about myself. When I go back to school, I'll probably be going for Marine Biology so I can work in a big aquarium someday. This is the least I can do to say thank you to this forum for helping me turn my life around and supporting me in a hobby that makes me so happy. I would never have been able to do this without all of you, and I am willing to fight for all of you.

I feel like I've been here forever too. You guys are like a second family. Some of you are the annoying brothers, or weird uncles, or crazy aunts...but you're family just the same. :)
