plecy help

Hypostomas species, hard to say which one though. The color/pattern is a bit off due to the multi-colored substrate.

ah. is that why i can't place him?

It's tough to properly ID a specific species w/out seeing the shape of the teeth, number of fin rays, etc. Given variable color/pattern to blend in w/surroundings, the same fish would look quite different on a darker, single-colored substrate. That looks like one I picked up along with a used tank some time back. I had no desire to keep the fish, and took it to the lfs for ID. I was told it was a common pleco.
The common pleco's are mass-produced in outdoor ponds in Florida. If the price was low that's likely where it came from. Imported or even tank bred "exotic" pleco's are generally quite a bit more expensive. The common BN is the exception, they're so plentiful the price is comparable to common pleco's.

theres a chance something is wrong... but also a really good chance that he is fine... when they are comfortable they let their gaurd down and when they are asleep in their caves the sometimes just sorta drift down and lay on their backs for a while...

as for an id... hard to say without seeing his fins up .. try and get a shot of him like that and a shot of him sucking on the glass if possiable... if you had a darker more solid substrate his color would darken and look really nice..... if i had to guess id call him an L165 (Pterygoplichthys gibbiceps.. aka sailfin pleco aka gibby aka my personal fav so far)

between 6"-8" is generaly when they hit sexual maturity.. so much like a teenage boy.. you may notice that he gets a lil weird and more aggressive...

ya, when i got him he was a lot darker and he had spots all over with light striping in the back ground. he may be what you said, cause his fins are pretty big.
