Should I upgrade from 37t to 40b?

Would you swap out a 37t tank for a 40g breeder?

I have a spare 40g breeder, but due to the "limited" number of tanks that I'm allowed to have, it's sitting in storage. I have someone interested in my 37g tall tank, in exchange for the tank, this person would foot the bill of setting up the 40g, so it would be no cost out of my pocket.

The 37g tank is planted, but i've found that it's a bit tall to get light to the bottom... I run about 90w of t5 lighting.
The tank presently contains:

2 x Kribs and about 30 fry
4 x Praecox Rainbows
4 x Neon tetras
1 x Bristlenose Pleco

The more I get into this hobby the more I appreciate the surface/swim area of the fish to the height of the tank. Fish just seem happier with more length and depth. The krib pair can cause quite a bit of stress on the other fish when breeding.

The additional swim area would provide a home to some fish that are overcrowding my 60g tank without having to exchange them at the LFS for credit. My concern is the height of the tank... however I also have a 50g breeder that only has 1.5" of additional visable area height, I really like it.

However, I since I AM looking at breeding fish... perhaps using this 40g in the garage as a growout tank would be a better option.

Thoughts?
