I always thought about that. As silly as this case is, Etrader will probably have to dish out a pretty penny defending their case... Are they allowed to countersue for legal costs ?

I believe that they can as the law stands now. Perhaps a lawyer can confirm this for us?
 
A few years back, Sting tried to sue a guy to obtain rights to the website www.sting.com . From my recollection the suit was tossed, as the judge ruled that 'sting' was too generic of a term for him to claim any rights to.

I think that it will be even harder for Lindsay Lohan to claim rights to usage of the name 'Lindsay.' My guess (and hope) is that it will just get tossed and E*Trade won't need to spend much to deal with this.

Hopefully the suit will get lots of attention, and she'll come off looking like a bigger dope than she already has...
