Then you must not be aware that Japanese restaurants are using glo-fish as a way to offer "Glow-in-the-dark Sushi". There is no gray area. GM is GM. The makers of the glo-danio strain have a similar type patent and yes it gets enforced. It doesn't make world news because at present, it's impact it not as widespread.
The glo-fish strain was supposed to be sterile only it didn't turn out that way.
