Family Files Claim Over Teen's Shooting

LOS ANGELES (AP) - The family of a 13-year-old boy who was fatally shot by police chasing a stolen car filed a claim against the city alleging wrongful death and civil rights violations, an attorney said Tuesday.
The Feb. 6 shooting of Devin Brown was "one of the worst cases of a police homicide that we have ever seen," lawyer Brian Dunn said at a news conference.
The teen's mother, Evelyn Davis, attended but did not speak.
Dunn represents the teen's mother and works in the office of former O.J. Simpson lawyer Johnnie Cochran. He filed the claim with the city on Friday seeking unspecified damages of more than $10,000.
The claim contends the city is to blame for the boy's "wrongful death arising out of excessive force" and also claims "deliberate indifference to the maintenance, training and control of the Los Angeles Police Department."
If the claim is rejected, Dunn said the family can file a lawsuit.
The city attorney's office had not received the claim by Monday afternoon and could not comment, spokesman Frank Mateljan said.
Brown, who is black, was behind the wheel of the stolen car that led officers on a 4 a.m. chase and backed into a patrol car. A Hispanic officer fired 10 shots at the driver.
"At most, what we have heard is that he was driving a car that didn't belong to him," Dunn said. "We don't have the death penalty for that."
The city Police Commission revised the LAPD's shooting policy after the teen's death. It now prohibits officers from firing at a moving vehicle unless the officer or another individual is threatened with deadly force other than the vehicle.
Ah excuse me the kid was underage driving a vehicle that was not his at 4 in the morning, but he was not in the wrong the police were??????????How were the police to know the age of the driver at 4 in the morning all they saw was a vehicle they were trying to stop. No I don't agree with the shooting per see but since I was not there I can not say how threatened the police officer felt.
Now as to their new shooting policy: a moving vehicle is not considered a weapon when used in a threatening manner, oh what I know moving vehicles can't kill, mame or destroy, right????????????? Get real..............
