No, I think Sploke is most likely scum.
I said to test JL because if he is scum you get one and if not you lose an innocent
If you vial Sploke, who I believe to be scum then you get an innocent back, provided the vial doesn't kill them. If Sploke was scum and the vial doesn't kill him then you get an innocent back and remain neutral ( gain one to the one you lost ) and the scum loses one.

just mixed up my order.
In my head it was test first vial second and the names stayed in the same spot. I'm tired and if I have to look at another aromatic ring, or steroid im going to go insane....

To be honest, if we are not going to test/vial the same person (which after thinking about it I don't think I want to)...I would rather vial/invest the two. Vial one (Sploke) and invest the other (John)

I'm playing devil's advocate here but what if Sploke is innocent then we've created another evil, or worse yet what if he has the vial. If it doesn't kill whoever he uses it on we will still assume he (Sploke) has been switched to evil. I'm back to thinking whoever has it should use it on the test choice.

Bally, I'm sure your tired but, for one you state...if YOU vial, test YOU gain loose, the wording alone made me wonder, wouldn't WE vial/test if you are a innocent would you not be included in that?

I don't have the vial so I said you, directed towards the one who does have the vial.

Ok, see here is what I was thinking...if he is evil, I'll bet the invest on John will come back innocent. I am fine with doing them the other way around. If he is innocent, I'll bet the invest on john will come back evil.
