are you kidding? only a mistomener? i take it your sister is suing for the damages correct? she should sue for pain and suffering also. there has to be at least one injury and the children are going to remeber this forever.
 
OMG! Three children were in this too? A mistorminer? Are you kidding me? What is wrong with your police dept.? They need to pursue a lot more than that. If that happened in my town they would be ready and wiling to throw the book at him.

Misdemeanor ? Is this his 'first' offence ? He'd likely done this at least 10 other times before he got in trouble. Does he have to take driving classes and see crashed cars or half living victims, or dead victims' relatives to absorb the impact of the effects of DUI ? It's sickening. People brush off their inebriation as slight at the cost of others' lives. They're often too drunk to make important decisions anyway. Friends should quit being diplomatic and more caring. Sigh. I agree, tougher laws and better programs are a must. After dark, especially on weekends, I'm always on the lookout for drunk drivers if I'm on the road. Make sure there are no possible long term orthopedic problems with your sister & kids. Else, stick that drunkard with everything you can think of. Good luck !
 
It seems like some people get hit hard by the law when caught drunk driving (in this state). Just recently I was listening to a radio show and they were talking to those caught drunk driving, and on their first offense, some even have the cops checking on them three years later. Yet, some get away with a slap.

I've been hit by a drunk driver. They never caught the guy though. So I had no one to go after for it. Luckily, I suffered no more than whiplash.

And it's not only those that are out there driving drunk. If you are tired, please don't get behind the wheel. It's just as bad as driving drunk. Judgment is off, reflexes are slow and you chance falling asleep. I've almost fallen asleep at the wheel (thanks to meds, which I now only take at night), and it frightens me. If I find myself being just too tired, I won't go anywhere. My husband was in an accident three years ago from falling asleep at the wheel. Luckily, no one else was involved and all that was damaged was someone's fence. He's lucky he somehow managed to maneuver his car between two trees instead of right into them.

So please keep that in mind as well.

Where I lived in New Mexico they cracked down hard on drunk drivers. Their policy is .08 gets you 28.....days in jail that is. You get busted with a .08 on the breathalizer and you go to jail for a month. That is hard core but helps ALOT.

Here in Illinois they are giving harsher punishments. I know a woman(whom I don't care for by the way) who actually had to have a breathalyzer installed in her van. She has to blow in it when she starts it up and has to blow every 15 mins while she is driving...if she fails to blow or if she fails, the vehicle shuts down and the horn starts blaring and lights flash. She also had to pay to buy the device and have it installed. Cost her over 1000 bucks. I think this should be the norm for first time offenders.
