maybe they are worried that if kept in a tank they will be exposed to non native diseases such as ick and then be returned to the wild.

well no fish should be returned to the wild. not only due to disease risk but going from cold water...to room temperature is stressful enough....going from room temp to cold water will more then likely be lethal unless you spent hours and hours accimilating them
According to this you can keep up to 5 if they are not endangered.

Ok that works.. I was only planning on keeping a few anyway, the rest will be given to people I know with ponds.
