One thing to bear in mind is that the bird might be protected by state or federal regulations. You don't want to get into trouble with the law over this. Better to just put a protective barrier around your pond.
(Decades ago, when I was a child, my late uncle had a beautiful fancy goldfish pond in El Monte. One day, he came out to find a cat (I remember him saying "That [censored] orange tabby!") had caught all his fish and lined them up at the edge. :nilly: I really don't know what Uncle Elmer did after that.)
